An even larger group is being silenced through violence, arrests, intimidation or lawsuits. Environmental human rights defenders in Latin America and the Caribbean are suffering severely from these violations. In 2021, the region took a historic step by bringing the Escaz\u00fa Agreement into force. This article explains how this binding treaty makes a difference to the rights of conservationists.<\/strong><\/h4>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p><em><mark style=\"background-color:rgba(0, 0, 0, 0)\" class=\"has-inline-color has-cyan-bluish-gray-color\">Header photo: Colombian Amazon Rainforest (c) Mariel Cabero \/ IUCN NL<\/mark><\/em><\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>The Escaz\u00fa Agreement is a regional political treaty in Latin America and the Caribbean to improve access to information, participation in decision-making and access to justice in environmental matters. The full name of the treaty is \u201cThe Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters in Latin America and the Caribbean.\u201d From 20 through 22 April 2022, one year after its entry into force, the first Conference of the Parties (COP1) of the Escaz\u00fa Agreement took place.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<h2 class=\"wp-block-heading\">Unique agreement<\/h2>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>Escaz\u00fa is the first environmental agreement in Latin America and the Caribbean, but it is also one in its kind worldwide. As the world&#8217;s first binding agreement with provisions on environmental and human rights activists, it is a pioneering instrument in the context of environmental protection and human rights.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>These provisions are of great importance in a region where it has been unsafe for conservationists for years. Colombia, Mexico, Brazil, Guatemala and Honduras are among the most dangerous countries in the world for environmental activists, according to the <a href=\"https:\/\/www.globalwitness.org\/en\/campaigns\/environmental-activists\/last-line-defence\/\">latest Global Witness report<\/a>. Among other things, the treaty contains a specific clause that obliges states to guarantee and facilitate the safe participation of environmental human rights defenders in political decision-making, and to prevent threats and violence.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>It is the first treaty in the world to contain provisions on human rights defenders in environmental matters (Article 9)<span class=\"footnote_referrer\"><a role=\"button\" tabindex=\"0\" onclick=\"footnote_moveToReference_80503_1('footnote_plugin_reference_80503_1_1');\" onkeypress=\"footnote_moveToReference_80503_1('footnote_plugin_reference_80503_1_1');\" ><sup id=\"footnote_plugin_tooltip_80503_1_1\" class=\"footnote_plugin_tooltip_text\">[1]<\/sup><\/a><span id=\"footnote_plugin_tooltip_text_80503_1_1\" class=\"footnote_tooltip\">Article 9. The horrific and long list of murdered conservationists in Latin America and the Caribbean has forced the region to push for a treaty that would oblige countries in the region for the first time to protect environmental and human rights defenders.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<h2 class=\"wp-block-heading\">Public participation in environmental issues<\/h2>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>In Latin America and the Caribbean, the agreement is a breakthrough in international environmental law, because it clearly highlights the importance of public participation in addressing environmental issues. According to the treaty, citizens must have access to active participation, information and justice. It also includes measures to establish and strengthen the capacities and collaboration of environmental and human rights activists, ultimately helping to ensure the individual&#8217;s right to a healthy environment.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<h2 class=\"wp-block-heading\">Increasing access to information<\/h2>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>The treaty contains 26 articles and the agreements are set out in Articles 5 to 9<span class=\"footnote_referrer\"><a role=\"button\" tabindex=\"0\" onclick=\"footnote_moveToReference_80503_1('footnote_plugin_reference_80503_1_2');\" onkeypress=\"footnote_moveToReference_80503_1('footnote_plugin_reference_80503_1_2');\" ><sup id=\"footnote_plugin_tooltip_80503_1_2\" class=\"footnote_plugin_tooltip_text\">[2]<\/sup><\/a><span id=\"footnote_plugin_tooltip_text_80503_1_2\" class=\"footnote_tooltip\">Article 5. They state, among other things, that people have the right to access information about the environment and how this information should be collected and disseminated. In addition, citizens should have influence on environmental decision-making and all people should have access to environmental justice.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>Several partner organisations of IUCN NL work in areas with many environmental conflicts take, often linked to deforestation. In the Colombian Amazon and Chiquitania in Bolivia, for example, communities have no information about what is happening to their environment and no access to justice. That is why, as part of the Forests for a Just Future programme, we gather information from Latin American countries where deforestation for the production of palm oil takes place.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<h2 class=\"wp-block-heading\">Start of negotiations<\/h2>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>Negotiations for the treaty started in 2012, during the United Nations Conference on Sustainable Development in Rio de Janeiro. Governments of ten Latin American and Caribbean countries <a href=\"https:\/\/es.wikipedia.org\/wiki\/Declaraci%C3%B3n_de_R%C3%ADo_sobre_el_Medio_Ambiente_y_el_Desarrollo\">expressed their support for a regional agreement<\/a> that would establish rights in environmental issues.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>In March 2018, after years of negotiation, states agreed to the treaty in Escaz\u00fa in Costa Rica. The agreement was created and negotiated entirely locally and is therefore supported by the entire region. Government representatives, mainly the Ministries of Foreign Affairs and Ministries of the Environment, negotiated and approved the text.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<h2 class=\"wp-block-heading\">Signed by 25 countries<\/h2>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>Subsequently, the agreement was opened for signature to the 33 Latin American and Caribbean countries. So far, 25 governments have signed and <a href=\"https:\/\/treaties.un.org\/Pages\/ViewDetails.aspx?src=IND&amp;mtdsg_no=XXVII-18&amp;chapter=27&amp;clang=_en\" target=\"_blank\" rel=\"noreferrer noopener\">15 states have ratified the text<\/a>, meaning the treaty&#8217;s obligations are also enforceable at the national level. These countries are: Antigua and Barbuda, Argentina, Bolivia, Chile, Colombia, Ecuador, Guyana, Mexico, Nicaragua, Panama, Saint Vincent and the Grenadines, Saint Kitts and Nevis, Saint Lucia, and Uruguay.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>Colombia, which has seen <a href=\"https:\/\/www.globalwitness.org\/en\/campaigns\/environmental-activists\/last-line-defence\/\">the world\u2019s highest number of murders of environmental activists<\/a> for two years in a row, ratified the agreement on 10 October, 2022. <\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<h2 class=\"wp-block-heading\">Making people aware of their rights<\/h2>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>Now that the treaty has been ratified in several countries, it is important that communities and environmental activists themselves are also aware of their rights. As part of the Forests for a Just Future programme, IUCN NL will start a capacity building project in which we inform mainly women in remote areas in the Amazon about their right to participate in environmental matters and what steps to take of this right is violated.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<h2 class=\"wp-block-heading\">First Conference of the Parties<\/h2>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>The first Conference of the Parties (COP1) of the Escaz\u00fa Agreement took place from 19 through 22 April, 2022. A year after the entry into force of the convention, the COP1 participants discussed how the general public can be more involved in the agreement and what financial resources are needed to properly implement it.<\/p>\n<\/div>\n\n<div class=\"block block-container small-12 large-offset-1 large-10\">\n<p>In the context of the COP1, a series of parallel sessions on various themes was organised.
